Dumitru Oanta, 56, of Hancock was found guilty of first-degree sexual abuse and second-degree sexual abuse March 31 after a jury trial.
Delaware County Judge Carl Becker sentenced Oanta to five years in prison with five years of post-release supervision and ordered him to pay $1,370 in fees, including sex-offender registry fees.
A Delaware County jury deliberated more than three hours March 31 before finding Oanta guilty on the two charges. He was acquitted on a charge of first-degree rape, Delaware County District Attorney Richard Northrup said.
The charges stemmed from a January 2003 incident involving a 13-year-old girl in the village of Hancock.
Northrup said the incident was not disclosed by the victim until about a year after the acts happened. Oanta was arrested July 30.
The sexual abuse charges involved forcible compulsion and sexual contact with a child under the age of 14, Northrup said.
Oanta, a Romanian national, appeared in court with his attorney, Lyndon Summers III, and an interpreter.
Oanta told the court, through the interpreter, that he was not satisfied with the results of his trial. He said his victim is Romanian and is considered an adult at the age of 14.
Becker said he was giving Oanta the minimum sentence for first-degree sexual abuse because the crime covers such a broad range of sexual contact, much of which is far more serious than the activity Oanta was convicted of committing, which involved touching the girl’s breasts.
Northrup noted that Oanta will probably be deported after he completes his prison sentence.
In a separate case, Randy S. McClenon, 47, of Sidney was scheduled to appear in court with his attorney, Jeffrey Radol, for a hearing to suppress evidence and a confession in a rape case involving a child.
However, McClenon entered an Alford plea of guilty — a plea that allowed him to accept the charge while not admitting to the crime — because he continues to claim that he is factually innocent.
McClenon pleaded guilty to first-degree criminal sexual act. A charge of first-degree rape was dismissed.
Northrup said McClenon’s alleged victim was a 3-year-old girl.
The child’s parents submitted a victim impact statement in which they said McClenon had caused untold psychological and emotional damage on the child, the parents and other family members who love and care for the child, Northrup said.
Becker sentenced McClenon to eight years in prison with five years of post-release supervision and ordered him to pay $1,370 in fees, including sex offender registry fees.
Deputies said McClenon acted in an informal day-care capacity for the child. He is accused of having sexual intercourse and other sexual contact with the child Aug. 15.
